ANSWP Commander Bill White's New Chicago Trial Date Set For July 27th; New Judge Lynn Adelman Presiding
After being locked up since October 17th, 2008, ANSWP Commander Bill White will finally be going on trial in Chicago, beginning on July 27th. The trial is expected to last a week.
A major part of the delay was the recusal of the previous judge, William Hibbler, primarily because he was part of the stable of Chicago Federal judges including Joan Lefkow. White's defense counsel suggested that any Federal judge from the Chicago district might be biased because of their common association with Lefkow. White originally wrote on the now defunct Overthrow.com that he was happy to hear in 2005 that Judge Joan Lefkow's husband and mother had been killed in their Chicago home. White is being charged with solicitation because he published the personal information of the Jewish jury foreman in the Matt Hale trial, where Hale was railroaded for allegedly "soliciting" the murder of Judge Lefkow's parents. If convicted, White could face a maximum of 10 years imprisonment.
The replacement judge, Lynn Adelman, has scheduled White's trial to begin on July 27th. Adelman's professional rating can be viewed HERE. White had also asked that his trial be moved from Chicago to the Western District of Virginia, because he was in Roanoke at the time he posted the personal information about the Matt Hale juror. But Judge Adelman rejected that theory, noting in an opinion that if White's intent was to encourage someone to harm the juror, the violence would have taken place in Chicago.
Even though White made no direct threats, prosecutors say he publicized the juror's home address and telephone numbers to an audience he knew was prone to racism and potential violence. Defense attorneys have said that White meant no harm, and his online comments should be protected by the First Amendment.
Once White's trial is completed in Chicago, he will return to Virginia to face more charges. In December, a federal grand jury in Roanoke indicted White on seven charges of threatening people across the country, including a banker, a newspaper columnist, a civil rights attorney and a small-town mayor. Specifically, in December 2008, he was charged with five counts of communicating threats in interstate commerce, one count of communicating an extortionate threat in interstate commerce, and one count of witness intimidation. He is accused of "targeting" individuals with whom he disagreed from 2006 to 2008 for racial reasons. If found guilty of communicating threats in interstate commerce, White could face a maximum punishment of five years in prison for each count of the indictment. If found guilty of communicating extortionate threats in interstate commerce, White could face a maximum punishment of 20 years in prison. If found guilty of witness intimidation, White faces a maximum punishment of ten years in prison. Each of the aforementioned charges also entails a potential fine of up to $250,000.
